2 Ulster County poll workers sue to have votes counted in 46th state Senate District race

Two polling place inspectors are appealing a judge’s decision to throw out their votes  along with the ballots of 51 other Ulster County poll workers in the tight 46th state Senate District race.

Acting state Supreme Court Justice Guy Tomlinson of Montgomery County on Dec. 18 certified Assemblyman George Amedore, R-Rotterdam, the winner of the 46th Senate District race over Duanesburg Democrat Cecilia Tkaczyk by a margin of just 37 votes, 63,141 to 63,104, but Tkaczyk has appealed the decision.

Tkaczyk’s attorney has called mistakes that invalidated more than 300 paper ballots cast in the race, including the absentee ballots for the poll workers, “hyper-technical.”

The Ulster County poll workers, Barbara Bravo and Carole Furman, are independently appealing the decision to the Appellate Division of state Supreme Court, but attorney Lanny Walter, who is Furman’s husband, said Tuesday he expects the case to go to the state Court of Appeals, the state’s highest court, as whoever loses is unlikely to be willing to let the decision stand.  POST
